Note: All items must be picked up by the specified removal dates & times unless prior arrangements have been made with the auctioneer. Any remaining items will be considered abandoned. ID and paid printed receipt is required for pick-up. Buyers are responsible for bringing boxes and sufficient help for heavy or bulky items. Please note that some lots may require at least two able-bodied individuals for safe removal.

By registering and participating in any of our auctions, you agree to the following Terms and Conditions. You must be 18+ and legally able to enter a contract. You are responsible for all activity on your account. Please read the terms and conditions carefully before placing a bid.
Helminiak Real Estate & Auction, LLC. has made every effort to provide accurate descriptions of all auction items. However, all items are sold "AS-IS," "WHERE IS," and "WITH ALL FAULTS." No warranties or guarantees, either expressed or implied, are provided by the auction company or the seller regarding condition, authenticity, usability, or fitness for a particular purpose.
Online Bidding Platform (BidWrangler): Helminiak Real Estate & Auction, LLC. utilizes the BidWrangler platform to conduct online auctions.
Buyer's Premium: 15% Example: Final Bid: $100 Buyer's Premium (15%): $15 Total: $115 (plus applicable sales tax)
Sales Tax : Sales tax will be automatically calculated at the time of checkout based on a variety of factors including: State, City & County jurisdiction requirements. The buyer is responsible for payment of sales tax if applicable. All vehicles will be subject to applicable sales tax and it will be collected by the Title Licensing agency when the purchaser transfers the title to their name in the county and state they live in. Valid resale or exemption certificates must be provided prior to payment.
Participation Requirements: Valid Credit Card required for bidding approval. Provide accurate contact information. Be legally able to enter into binding contracts. Helminiak Real Estate & Auction, LLC. reserves the right to approve, deny, or revoke bidding privileges at any time.

Non-Payment/Default: If payment is not received within 2 days: The bidder will be considered in default. Items may be resold. The defaulting bidder is responsible for any price deficiency. Helminiak Real Estate & Auction, LLC. reserves the right to: Charge the card on file. Pursue legal action or collections. Unpaid balances may incur 2% monthly interest as well as collection fees and attorney costs.
No Returns/No Refunds: All sales are final. No refunds. No returns. No chargebacks. By bidding you waive any right to dispute item condition or functionality.

Pickup & Removal: Buyers must present ID and paid invoice at pickup. Buyers must remove items during scheduled pickup times. Failure to comply: $5/day storage fee may be applied. After 7 days, items are considered abandoned. Abandoned items will be resold with no refund.

Soft Close (120 Seconds): If a bid is placed within the final 120 seconds of a lot's scheduled closing time, the bidding for that lot will automatically extend by an additional 120 seconds. This process will continue as long as bids are placed within the extension window. Helminiak Real Estate & Auction, LLC. is not responsible for missed bids due to technical issues, internet delays, or user error.
Auctioneer Rights: Helminiak Real Estate & Auction, LLC. reserves the right to refuse service to any bidder, cancel or suspend bidding privileges and modify auction terms at any time. Announcements made day of auction take precedence over written materials.
Max (Proxy) Bidding: The maximum bid feature allows a bidder to set a top bid amount. The system will automatically increase bids incrementally on the bidder's behalf. Bids increase only as competing bids are placed. If two bidders enter the same max bid, the first entered bid takes priority. Bidders may receive notifications based on account settings.

In the event of a tie between a bid placed by you online and any other identical bid(s) (including bids made in person at the Sale, telephone bids, absentee bids, and other online bids), it will be at the auctioneer's discretion as to which bid shall be accepted.
