The following is a summary of the Terms and Conditions for this online auction for real estate situated at 5691 County Rd. 1-2 Swanton, OH 43558 aka Parcel:  26-051352-00.000 (the “Property”), being sold ‘AS IS’ on Thursday, July 16th, 2026 (the “Auction”) with bidding ending at 6:00pm EST.

The Bidder agrees to abide by the Terms and Conditions of the online auction and will execute the auction real estate purchase agreement. If you have not read and reviewed the Terms and Conditions, DO NOT BID. In addition to the Terms and Conditions, the Bidder also understands the following:

  1. Each Buyer is responsible to complete an AUCTION REGISTRATION. To participate in this ONLINE ONLY Auction, you must register at HELMINIAKAUCTION.COM. Online bidding will CLOSE on Thursday, July 16th, 2026 at 6:00pm EST.
  2. After registering, you are required to provide PROOF OF FUNDS. Whether you are financing or paying in cash, proof of funds is necessary before you can bid. If you choose to finance, your proof must cover both the Earnest Money Deposit and the down payment. Acceptable forms of proof include bank statements, brokerage account statements, a line of credit, or any funds readily available. Please email your PROOF OF FUNDS to: info@helminiakauction.com.
  3. When you submit a high bid and it gets accepted, you become contractually bound to purchase the real estate at the price indicated in YOUR BID, along with the BUYER’S PREMIUM, FEES, and any other relevant Buyer charges.
  4. The successful bidder will need to sign a purchase agreement and submit an EMD (Earnest Money Deposit) of $10,000.00 within 24 hours following the auction's conclusion. This deposit can be made via ELECTRONIC TRANSFER, CASHIER’S CHECK, or PERSONAL CHECK and will be securely held at Louisville Title.

EARNEST MONEY DEPOSIT: A $10,000.00 Deposit will be required to be collected within 24 hours from the successful bidder(s). The deposit must be in the form of ELECTRONIC TRANSFER, CASHIER’S CHECK or PERSONAL CHECK made out to Louisville Title. The remaining balance will be due at closing no later than 45 days from auction. The final bidder's check will be deposited into the title company's escrow account, which will then be credited to the Buyer upon closing. The terms of the contract are non-negotiable and if the Buyer fails to close, the deposit is non-refundable. The Buyer understands and agrees the earnest money deposit will be released to the Seller and Helminiak Real Estate & Auction, LLC.-Key Realty.

TITLE: The Seller agrees to furnish clear title with a guaranteed certificate of title at closing, at Seller's expense. Buyer is responsible for their portion of closing fees. Taxes will be prorated. Closing will be held at Louisville Title within 45 days of auction closing.

BROKER PARTICIPATION: We welcome Broker Participation. Please call and register your Buyer 48hrs. prior to auction. A form is available in the MLS. A Broker Participation form must be completed in order to register your Buyer. Failure to do so voids the Broker Participation.

BUYER'S PREMIUM: A 10% Buyer's Premium will be added to the final bid. The final bid plus the buyer's premium equals the final purchase price for the property.
